This agreement is between Antonio Atacan, Licensed Pennsylvania Real Estate Agent, at Prudential Fox & Roach Realtors, an Independently Owned and Operated Member of the Prudential Real Estate Affiliates, INC. and the antoniorealtor.com, atacangroup.com or centercityrealestate.com website visitor.

In consideration for services to be performed by Antonio Atacan:

1. Visitor asserts that he or she is a bona fide buyer or seller of real estate;

2. Visitor has not signed any agreement with a real estate agent or agency that would prevent Visitor from entering into this Agreement with Antonio Atacan and, the Visitor is not working with another real estate agent or agency;

3. Visitor asserts that neither he or she or their spouse is a real estate agent in Pennsylvania or elsewhere;

4. Visitor agrees to abide by all copyright restrictions placed on the content of the antoniorealtor.com site including, but not limited to, any material or data compilations where the copyright is held by Antonio Atacan or others;

5. Visitor agrees that any electronic or printed copies of property listings - or other content from this website will be for Visitor's sole and exclusive use and that Visitor will not attempt in any manner to otherwise distribute such site materials;

6. Visitor agrees that he or she will not contact the seller of any property introduced to Visitor through the antoniorealtor.com, nor will Visitor attempt to gain access to a property through another Realtor or through the owner of the property unless it is through an appointment set by Antonio Atacan;

7. Visitor acknowledges that when property showings commence, Visitor will be requested to enter into a written Buyer Representation Agreement that will replace this Agreement;

8. Visitor is aware that Antonio Atacan will be compensated by the Listing Broker or by the Owner of the Property;

9. Antonio Atacan shall: a) Use diligence in maintaining current content of the MLS data on the antoniorealtor.com; b) Provide assistance requested by Visitor having any difficulty navigating Antonio Atacan's web site; and, c) and use his best efforts to procure for Visitor requesting a property viewing, an appointment to show such property;

10. Visitor agrees that Antonio Atacan represents Visitor as a Buyer's Agent and that Visitor is a client of Antonio Atacan. If the property is also listed by Antonio Atacan, both the Buyer and the Seller will be fully and equitably represented by Antonio Atacan through Dual Agency Representation. At either parties request another Prudential Fox & Roach Realtor will be appointed as the designated Buyer’s Agent at no additional cost. 

11. Visitor agrees that Antonio Atacan may also represent other prospective buyers seeking to purchase properties that may meet Visitor's criteria;

12. Visitor agrees to use this Web site at his or her own risk. If the use of this Web site or the materials therein results in the need for servicing or replacing property, material, equipment or data, Antonio Atacan is not responsible for those costs. In no event shall Antonio Atacan and/or its suppliers be liable for any direct, indirect, incidental, special or consequential damages arising out of or in any way connected with the use of this web site or with the delay or inability to use this web site, or for any information, products, and services obtained through this web site, or otherwise arising out of the use of this web site, whether based on contract, tort, strict liability or otherwise, even if Antonio Atacan or any of its suppliers has been advised of the possibility of damages;

14. Visitor agrees that the information, software, products, and services published on the antoniorealtor.com site may include inaccuracies or typographical errors. Property information is provided by Trend Multiple Listing Service, and the information is deemed reliable, but not guaranteed. Visitor understands that Antonio Atacan is providing this site and its contents on an "as is" basis without warranty of any kind. Antonio Atacan and/or its respective third-party providers reserve the right to modify the contents of this site without notice;

15. Visitor agrees that this Web site contains hyperlinks to Web sites operated by parties other than Antonio Atacan.  Antonio Atacan is not responsible for their contents nor in any way does the hyperlink imply that Antonio Atacan endorses the material on such Web sites or any association with their operators;

16. This agreement will commence when Visitor selects the "I Agree" button, enters Visitor's name and E-mail address in the spaces provided at the end of this Agreement and Visitor receives an E-mail at Visitor's E-mail address from Antonio Atacan providing Visitor with a password to gain access to Antonio Atacan's private intranet maintained for the exclusive use of its clients.

17. This Agreement will remain in full force anytime the Visitor enter and uses the antoniorealtor.com site.
